A rail transport operator (RTO) may apply to the National Rail Safety Regulator (NRSR) for an exemption in respect to a specified railway operation carried out or which are proposed to be carried out. A requirement of exemption is to demonstrate to the NRSR that a RTO is a rail infrastructure manager (RIM) or rolling stock operator (RSO) in relation to the railway operations in respect for which the exemption is sought.

The RSNL requires that RTOs must apply for and be granted exemption in accordance with sections 205 – 207 of the Rail Safety National Law, before they commence undertaking railway operations.

To apply for an exemption an RTO must complete the Application for Exemption Form. This form should be submitted to the ONRSR with attached supporting documentation describing their Safety Management System.

An RTO applying for variation of exemption is advised to contact the ONRSR early in the process to clarify the requirements. A completed Application for Variation of Exemption Form will be required.
