A rail transport operator (RTO) may apply to ONRSR for an exemption relating to a specified railway operation either current or proposed. A requirement of exemption is to demonstrate that an RTO is a rail infrastructure manager (RIM) or rolling stock operator (RSO) in relation to the railway operations for which the exemption is sought.

Rail Safety National Law requires that RTOs must apply for and be granted exemption before they commence undertaking railway operations.

To apply for an exemption an RTO must complete the Application for Exemption Form. This form should be submitted to ONRSR with attached supporting documentation describing their safety management system.

An RTO applying for variation of exemption is advised to contact ONRSR early in the process to clarify the requirements. A completed Application for Variation of Exemption Form will be required.
