The degree to which upstream duty holders influence the decision making of the accredited entity under the RSNL has been an emerging issue for several years. The issue of which entity demonstrate “effective control and management” has become more complex as different governance models for rail services are implemented in different jurisdictions.

This theme will focus on the contract the accredited party holds to deliver rail services and how critical safety and investment decisions are made that align with the principle of the accredited party being able to demonstrate effective control and management over such decisions.
